These terms and conditions help to keep this website a safe place to trade and set out the full extent of any agreement reached between you and Spoiled Brat in connection with this site. You should understand that by placing an order, you accept the following terms and conditions:

Spoiled Brat is a trading name of Spoiled Brat (UK) LTD a company operated and registered in the Scotland

Your contract for purchases made through this web site is with Spoiled Brat (UK) LTD.

You agree that e-mail can be used as a long-distance means of communication.

No contract for the sale of any product will subsist between you and Spoiled Brat unless and until Spoiled Brat accepts your order by way of an e-mail confirming that it has received payment in full for all the goods you have ordered, and that the goods have been shipped to the specified address. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Spoiled Brat sends the e-mail to you (whether or not you receive that e-mail). This confirmation (not request) e-mail amounts to an acceptance by Spoiled Brat of your offer to buy goods from Spoiled Brat or a 3rd party supplier that is engaged on your behalf by Spoiled Brat.

You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.

Spoiled Brat will not pass on your personal or credit or debit card details to any third party.

You undertake that all details you provide to Spoiled Brat for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.

If there are any changes to the details supplied by you it is your responsibility to inform Spoiled Brat as soon as possible.

If you are contracting with us as a consumer, you have the right to cancel your contract at any time up to 7 working days after the day on which you receive the goods you ordered. You must take reasonable care of the goods whilst in your possession and they must be returned to us, promptly at your cost.

You must inform us of the cancellation of the contract.

This is not intended to be a full statement of all your rights under the Distance Selling Regulations. Full details of your rights under the Distance Selling Regulations are available from your Local Citizens’ Advice Bureau or your Local Authority’s Trading Standards Office.

The Regulations do not apply to made to order jewellery.

• Liability 

The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law Spoiledbrat (UK) LTD and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect Spoiledbrat (UK) LTD liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.

Spoiled Brat will do its best to correct errors and omissions as quickly as practicable after being notified of them.

All electrical products are covered by a minimum 12 month manufacturer's warranty. If your product develops a fault whilst under warranty, please refer to our returns policy.

• Processing of orders

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

All prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.

Credit and Debit cards are debited before items are shipped by Spoiled Brat. All prices include sales taxes (where applicable) unless otherwise stated.

Every purchase you make shall be deemed performed in Scotland. The law of the Scottish Government shall govern every aspect of contractual agreement concerning purchases made from this web site.

Spoiled Brat aim to arrange shipment of all in stock items within 24 hours of receiving your order. Your order may be delayed if the item is not in stock with our suppliers. Some items may be unavailable and the current stock status is approximate. You can keep track of your order status yourself on-line with the order tracking facility on the 'View My Orders' page.

Once your order has been confirmed, it's not currently possible for you to change it prior to dispatch.

• Delivery/Title/Risk

The period stated within which you will receive your order is approximate. Goods will be sent to the address given by you in your order and stated in the Order Confirmation. Please note that your goods may be part-shipped.

Title to any product ordered will pass to you once Spoiled Brat has received payment in full for that product.

If your delivery address is outside of the United Kingdom you maybe subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country; Spoiled Brat advises each customer to contact their local customs office for further information.

Please note that when shipping products internationally you should be aware that cross-border shipments are subject to opening and inspection by customs authorities.

• Discount Codes

Account discount codes - Discount codes may from time to time be offered to account holders; such codes may only be applied to purchases made through the account in respect of which the discount code was offered and registered.

Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website.

Unfortunately we are unable to amend your order if a discount code was not originally applied at checkout. A contract has been between us when you (the customer) clicks 'proceed' and this is for us providing you the goods at the price stated on the order.

Due to abuse of our discount codes, we now regret to inform you that any customer who places an order and then places a new one (exactly the same) with a discount code, will have their order cancelled (this includes pre orders). We reserve the right to cancel any order and any customer abusing our website's discount codes, will be blocked from using our website.

• Pre-Order Policy:

When you preorder a SpoiledBrat item, this product is reserved especially for you. Your credit card is charged when you place your order, and SpoiledBrat delivers your order as soon as it arrives to our store. All of our delivery dates are approximate, because manufacturers regulate this date according to their production schedules. We have no control over their production schedules or inventory. SpoiledBrat will refund your credit card if we cannot fulfil your preorder. If you cancel your order for any reason, we will happily offer you online store credit good for any SpoiledBrat item.

Please note: Your card will be charged at the point of purchase and the item will be dispatched within 24 hours of arriving in store.

We offer high demand items on a pre-order basis so customers wishing to purchase such sought after items, can secure their purchase. Pre-Order means that the item is paid for at the point of order and prior to the item arriving in-store.

All pre-order items are clearly marked throughout the site. We will always advise an expected delivery date on each item although, we do ask you to allow 2 weeks either side of this date to allow for unforeseen circumstances, such as shipping delays. Please also refer to discount codes (above)

White Trash Charm Jewellery & Jennifer Zeuner jewellery are made to order pieces. These can take up to 30 days for delivery as these are customised / produced to order. These items cannot be cancelled, refunded or returned.

• Terms of Payment

It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.

ANY online card not present fraud (CNP) or identity theft will be reported to the police.

All fraudulent transactions, will be investigated in full (including declined transactions). All will be passed to the police & all details will be given to the police; phone number, address etc. We will press charges on anyone who carries out fradulent card payments on our site and will look to pursue for damages. Furthermore, all fradulent payments will be blacklisted and be listed on a retailers fraud sharing site (this includes email addresses, addresses, names, IP address and phone numbers)

Authorisation of a transaction by whatever method does NOT guarantee payment. Authorisation will only check the availability of funds and that at the time of the transaction, and that the card has NOT been reported lost or stolen. Additional checks will be made, as appropriate before we release any goods. In the interests of preventing fraudulent use of credit, debit and charge cards, Spoiled Brat (UK) LTD will validate the names, addresses and other information supplied during the order process against commercially available records (e.g Electoral Roll data, Credit Reference Services). A third party may also be instructed to complete these checks.

By ordering from the spoiledbrat.co.uk website you consent to such checks being made. We may need to contact you by letter, telephone or email (to request either a copy of drivers licence or passport) to verify details before we are able to process and dispatch your order or we may be unable to accept your order. Any information given may be disclosed to a registered Credit Reference Agency which may keep a record of the information. All information provided will be treated in accordance with the Data Protection Act 1998. These measures are taken as extra protection for you, to ensure your online shopping experience with us is as safe and secure as possible.

These terms and conditions shall apply when Spoiled Brat accepts your order by e-mail confirming that it has received payment in full for all the goods you have ordered. They shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between Spoiled Brat and you relating to your purchase. Spoiled Brat advises that you print off and keep safe a copy of these terms and conditions once your order has been accepted by Spoiled Brat.
